​Fan Content Policy & Guidelines

Here at Mobius Digital we are constantly amazed and humbled by the fan content created by our community. And we want to encourage you to keep creating amazing content! This Fan Content Policy is meant to help answer some common questions we get about using Mobius Digital’s intellectual property (IP). We hope you understand any restrictions are to protect our properties and games so we can keep making wild and wonderful things for you all to enjoy.

If your Fan Content doesn’t fall under Fair Use, we ask that you follow these guidelines:
  1. Free: If it’s free, it’s generally okay. However there are specific restrictions, so please read this entire policy.
    1. “Free” means you do not require payment, subscriptions, email registrations, surveys, signups or otherwise condition access to your Fan Content on consideration of any kind. It also means it can’t be made in connection with, or in order to promote paid services, websites, or the like;
    2. Your Fan Content must be free for others, including Mobius Digital. Mobius Digital can share, view, access, and use it without obtaining your approval, e.g. we want to share your cool Fan Content on our social media! Rest assured, any shared art will include credit to the author;
    3. You may use Fan Content in connection with a Twitch, YouTube, or other account that is monetized with advertisements as long as you are otherwise in compliance with these guidelines.
  2. Unofficial: Don’t state, suggest, or imply your Fan Content is official, endorsed, sponsored, or approved by Mobius Digital or any of our affiliates.
    1. Do not use any of our trademarks or logos in a way that could be confused as indicating your work is official;
    2. Don’t mislead people into thinking your Fan Content is official in any way;
    3. Don’t ask us for assets or files from our games. We only share these with official partners, of which there are only a few;
    4. You can use the following note with your Fan Content to help clarify it’s unofficial:
      “This work is unofficial Fan Content created under permission from the Mobius Digital Fan Content Policy. It includes materials which are the property of Mobius Digital and it is neither approved nor endorsed by Mobius Digital.”
  3. Appropriate: Do not use Mobius Digital’s IP in a way that is offensive, racist, sexist, obscene, ableist, ageist, grotesque, damaging, disparaging, or defamatory. We have the right to stop or restrict your use of Mobius Digital’s IP at any time, for any reason or no reason. 
  4. Follow Local Laws: It should go without saying, but you are solely responsible for following any local, state, regional, or national laws as they pertain to your Fan Content. Mobius Digital will not be held liable for any violations or legal fees. We will also not act as legal counsel on your behalf. If you have any questions about your local laws, please seek counsel.

Some things are completely off limits. This list isn’t exhaustive, but should help you recognize what is and is not okay for Fan Content use:
  • ​Do not modify or remove our legal notices or policies.
  • Do not create NFTs (non-fungible tokens) or cryptocurrencies using our IPs or related to our IPs in any way.
  • Do not imply or indicate your Fan Content is approved, endorsed, or sponsored by Mobius Digital.
  • Do not create Fan Content which contains other trademarks, tradenames, services marks or logos or which violates any third-party right, including any privacy, publicity, intellectual property or proprietary right.
  • Do not create Fan Content that is harmful to minors in any way.
  • Do not create Fan Content that is or could be harmful to Mobius Digital, its business or brands or which defames or disparages any of its affiliates, managers, members, officers, employees, contractors or agents in a negative way (as determined by Mobius Digital).
  • Do not create Fan Content that promotes any illegal activity.
  • Do not violate any Terms of Service, End User License Agreements, or similar agreements associated with Mobius Digital IP.
  • Do not send our team your art without asking or being asked.

​If you follow the above, you should be okay! Please keep in mind, these guidelines do not, in any way, constitute a grant of any proprietary rights or licenses to Mobius Digital IP. We reserve the right to stop or restrict the use of our IP at any time – even if it follows the above guidelines – for any or no reason. We also reserve the right to update this policy and FAQ at any time and for any reason. 

​We’re a small team, so we won’t be able to answer every question you may have about the policy or about your work. This policy was written with the intent that it should answer most of your questions about what is and isn't allowed. The next section is an FAQ diving into specific questions we get asked a lot. ​Frequently Asked Questions

I make ___, can I sell it?
You may sell handmade fan works inspired by our games only if they are original works made by your hands and are sold in limited quantities. 
  • Do not use official art or assets from our games in your sold fan works. 
  • Do not make or sell fan works that are significantly similar to official items offered by our partners: link. 
  • You are not permitted to mass-distribute, mass-produce or manufacture fan works without our express written permission.
  • You are not permitted to set up crowdfunding (e.g. Kickstarter) for projects or products using or relating to our IP.
  • We reserve the right to stop or remove any works at any time at our sole discretion for any or no reason.
Will you help me or share game assets?
No. We only share assets with official partners. But, there are lots of fan communities where someone might be able to help you with your project.
What about mods?
We love mods of our games! You’re more than welcome to make a mod. As long as it’s free and follows the above guidelines, notably not violating the EULA, you should be okay.
Can I stream the games or post videos of game content on sites like YouTube?
Yes! Don’t forget to spoiler tag your videos out of courtesy for other curious travelers. 
Can I get a tattoo of something from the game?
Absolutely, we’re honored you want to keep a part of our games with you at all times. However, we won’t share art files in order to protect both our works and out of respect for your tattoo artist’s skills.
Can I request an official license or endorsement?
We only work with a few select partners. We are not currently distributing licenses or official endorsements for any of the following uses of our IP:
  • personal, non-commercial use
  • educational use
  • small batch sales of products, either online or local
  • distribution or creation of ports, mods, or sequels
  • streaming or distribution of gameplay video content
I saw a leak or spoiler online!
Oh no! Out of courtesy for other fans, please don’t spread a leak and please spoiler tag your content. Outer Wilds in particular is best enjoyed without spoilers and the community tends to be really great about marking spoilers. But leaks happen and they can be confusing and misleading because they might contain content that was ultimately removed from the shipped project.
